Wolfson said prosecutors have not completely ruled out charging Combs but stressed that there is currently insufficient evidence to bring charges against him.
“At this point, we don't believe we have sufficient evidence to charge anyone else with the death of Tupac Shakur,” Wolfson said.
“But, like any other case, if we come into more information, more evidence, we can always consider filing additional charges.”
His comments came a day after a Las Vegas jury convicted Duane “Keefe D” Davis of murder over the drive-by shooting that killed Shakur in September 1996.
During Davis’ trial, jurors heard recorded police interviews in which Davis claimed that Combs had offered him $1 million to kill Shakur and Death Row Records co-founder Marion “Suge” Knight.
Davis alleged that Combs wanted to “get rid of those dudes” and had several conversations with him about the proposed killings.
Combs has consistently denied any involvement in Shakur’s murder. A source close to the music mogul previously told TMZ that Combs had “absolutely nothing to do with the Tupac murder”.
Prosecutors argued that Davis organised a group of Crips gang members to retaliate after Shakur and others allegedly assaulted his nephew, Orlando Anderson, at the MGM Grand in Las Vegas earlier that night.
Davis was convicted of murder with the use of a deadly weapon and with the intent to promote, further or assist a criminal gang. He faces a possible life sentence, with sentencing scheduled for October 13.
Combs is currently serving a four-year prison sentence after being convicted on two counts of transportation to engage in prostitution.
