A Federal High Court sitting in Abuja, on Friday, issued an order stopping the Independent National Electoral Commission (INEC) from recognising the outcome of the national convention scheduled for November 15 and 16 in Ibadan, Oyo State, by the People’s Democratic Party (PDP).
In his judgment, Justice James Omotosho ruled that the PDP did not fulfil the necessary provisions outlined in its constitution and relevant laws, which specify the steps that must be followed before holding such a convention.
The judge stated that evidence presented by INEC and some respondents before the court revealed that congresses were not conducted in several states, in violation of the law.
Justice Omotosho also found that notices and correspondence signed solely by the PDP National Chairman, without the National Secretary, breached legal requirements, thereby rendering such documents invalid.
He explained that the PDP failed to provide the mandatory 21 days’ notice for its meetings and congresses, which would have allowed INEC to perform its constitutional responsibility of monitoring those events.
The judge added that the party’s non-compliance with the law placed the planned convention in jeopardy and urged the PDP to fulfil all necessary legal requirements before proceeding with the exercise.
Consequently, the court issued an order restraining INEC from receiving, publishing, or recognising the results of the convention slated to hold in Ibadan until the party complies with the law.
The judgment was delivered in the suit marked FHC/ABJ/CS/2120/2025, filed by three aggrieved members of the PDP.
The plaintiffs – Austin Nwachukwu (Imo PDP Chairman), Hon Amah Abraham Nnanna (Abia PDP Chairman), and Turnah Alabh George (PDP Secretary, South-South) – expressed dissatisfaction with the way the National Chairman has been managing the affairs of the embattled party.
