Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has formally accused the Attorney General of the Federation (AGF), the Director-General of the Department of State Services (DSS), and two prosecution witnesses of criminal perjury in his terrorism trial.
The complaint was submitted on 13 November 2025 at a Chief Magistrate Court in Abuja, ahead of the Federal High Court’s judgment scheduled for 20 November 2025.
According to a statement by Njoku Jude Njoku, Esq., representing the Mazi Nnamdi Kanu Global Defence Consortium, the two witnesses named are Mr. TAA (Prosecution Witness 1) and Mr. BBB (Prosecution Witness 2). The accusations include fabrication of evidence, subornation of perjury, and conspiracy to obstruct justice.
Kanu alleges that PW1 lied under oath by denying knowledge of Mr. Brown Ekwoaba, the DSS official responsible for supervising his detention, interrogation, and torture in 2015. Supporting evidence includes affidavits confirming visits and interviews with Ekwoaba, and official records showing his DSS postings from 2015 to 2020.
PW2 is accused of falsely testifying that he had never met Kanu before the court appearance, despite having led a video interrogation of him in July 2021. Certified court documents contradict this claim.
The complaint also highlights that both witnesses were masked during testimony to hide their roles in Kanu’s interrogations and the conditions of his detention, including solitary confinement and denial of legal counsel.
Kanu further charges the AGF and prosecutors with introducing surprise witnesses not listed in original evidence, relying on statements extracted under torture, withholding the identities of interrogators, and enabling false testimonies to secure a wrongful conviction. The DSS DG is accused of conspiring to pervert justice by coaching witnesses and suppressing exculpatory evidence.
These actions, according to Kanu, violate Nigeria’s Penal Code, the Administration of Criminal Justice Act 2015, and constitutional provisions guaranteeing fair trial rights and protection from torture.
Kanu is requesting criminal proceedings and punishment for perjury and conspiracy against the AGF, DSS DG, and the two witnesses, alongside a judicial declaration that the prosecution’s case is based on fabricated and coerced evidence.
The Mazi Nnamdi Kanu Global Defence Consortium noted that this is the first time a detainee held by the DSS has initiated criminal charges from detention against senior state officials, supported by documentary proof of coordinated perjury.
The complaint underlines a pattern of orchestrated false witness testimony aimed at sustaining charges unsupported by valid evidence.
