The Supreme Court has dismissed the lawsuit instituted by Adamawa State and ten other states controlled by the Peoples Democratic Party, seeking to contest the declaration of a state of emergency in Rivers State by President Bola Tinubu.
The action was filed in protest against the emergency rule that led to the suspension of elected officials in Rivers State for six months.
In a divided decision of six justices against one delivered on Monday, the apex court held that the eleven PDP-led states failed to present a credible cause of action capable of triggering the court’s original jurisdiction.
Reading the lead majority judgment, Justice Mohammed Idris ruled that the plaintiffs did not establish the existence of any actionable dispute between them and the Federation that would justify the Supreme Court’s intervention.
Justice Idris consequently struck out the suit, declaring that the court lacked the jurisdiction to hear the matter.
